All services provided by Spectrabumi are subject to these Terms & Conditions unless otherwise agreed in writing.
Spectrabumi offers inspection and testing services, including sampling, laboratory analysis, and technical consultancy.
Spectrabumi acts solely on behalf of the party issuing the instruction (the “Client”) and shall only report to third parties with the Client’s written authorization.
Services are rendered in accordance with the Client’s specific instructions, Spectrabumi’s standard service forms, general trade practice, or methods deemed appropriate by Spectrabumi.
Documents such as contracts of sale or bills of lading are considered for reference only and do not affect the scope of services.
Standard services may include: quantity/quality inspection, condition of goods/packaging, loading/unloading checks, sampling, and laboratory testing.
Any services beyond the standard scope require prior written agreement and may be subject to additional fees.
Reports and certificates reflect findings based solely on the instructions received and do not imply responsibility for matters outside the agreed scope.
The Client is responsible for providing access, necessary information, safety provisions, and disclosing any relevant hazards at the site.
Spectrabumi reserves the right to delegate service performance to qualified third parties.
Spectrabumi is not liable for test results or analyses conducted by the Client’s or third-party laboratories.
Spectrabumi’s liability is strictly limited to proven negligence, and any compensation shall not exceed five (5) times the amount of fees paid for the relevant service.
In cases of partial service failure, compensation will be calculated in proportion to the time spent on the disputed part.
Any claims must be submitted within three (3) months of service delivery or within one (1) year for failure to perform.
Spectrabumi does not assume any legal responsibilities or obligations of the Client toward other parties.
Spectrabumi is not an insurer or guarantor. The Client agrees to indemnify Spectrabumi against any claims exceeding the liability limits.
Additional costs may apply due to unexpected difficulties or delays during service execution.
If service execution is delayed due to inaccessible goods or premises, all waiting time and non-refundable expenses shall be charged accordingly.
Invoices are payable within thirty (30) days from the invoice date. Late payments are subject to 12% annual interest.
The Client may not withhold payment due to disputes or counterclaims and shall bear all collection-related costs.
In the event of Client insolvency or cessation of business, Spectrabumi reserves the right to suspend services and recover all outstanding amounts.
These Terms shall be governed by the laws of the location where the services are rendered. Any dispute shall be resolved by arbitration under ICC Rules, in English.
